Rooms” is a new multiple-choice optional amenity for
Residential and Lease/Rent Listings. “Flex Rooms”
is searchable and public visible. Remember, it will take a month
or two for the current listings to be updated with this new
information. Both the Residential and Lease/Rent Worksheets
have been updated,

allows an additional 40 characters of "Comments" to
be added to each Flex Room choice. Use the “Comments”

Updated
and Enhanced! From the Realist2 desktop results "Map
display" you can overlay the Flood Zone information. Using the
Map controls in the upper right corner, click the "Boundaries"
tool. From the "Boundaries" selection list, check-off "Flood Zone."
"Heat sensitive" flood zone information will overlay the map. "CTRL
left-click" on any parcel on the map to display the detailed
Flood Zone Data. Add any additional data and information to the map
you need. To print the Map, click "Print Grid/Map." You can
choose to print just the Map; just the Grid; or both. (the
printed map now includes the Flood Zone overlay information)

From the Realist2 detail report display, click the new "Flood Map"
tab. The Flood Map will be displayed along with
detailed Flood Map/Code information. This Flood Map report can be
printed by itself or included along with other Realist2 report
options. To print the "Flood Map" with or without additional
data, click "Print" in the bottom tool-bar. "Quick"
print prints just the Flood Map report with the Flood Code data and
detailed information.

The leadership recently
approved allowing up to 25 photos per listing, increased from
15. All of the
MLS Rules & Regulations regarding photos remain the same.
(please see bullet points below)
All 25 photos will appear on the Listing Detail Display
immediately & will be added to the multiple page
report "Full Client Detail w/Photo Gallery (All Property)"
and to a brand new report one page report "Summary Client
w/All Multi Photos (All Property)." Until these 2 reports
are completed, you can use the "Full Client Detail
w/Multi Photos (All Property)" report to print the primary +
6 extra photos; the "Half Page Client w/Multi Photos/Map (All
Property)" report will print the primary + 14 extra photos &
map; the "Summary Client w/Multi Photos (All Property Types)"
to print the primary + 5 extra photos; The "Full Client
Detail w/Photo Gallery (All Property)" report will print 15
photos & photo descriptions. (Note! these reports will all be
found in the "Enhanced Reports" section of the Reports page.)
All 25 photos are immediately public viewable on the
Listing Detail Display from the
CincyMLS.com
Open House Search, Manual & Auto-prospecting e-mails (via
the "Click here for Additional Information" link), Client Portal
& Broker/Agent websites using Rapattoni Smart Framing Links.
Brokers/Agents with a custom listing search on their website
have the option to show the extra photos or not. Realtor.com
publishes only the first 4 photos. Please contact Realtor.com
directly to review options to display additional photos.
From the
Rules & Regulations:
- 14.1 Images, which include
renderings, sketches, floor plans, etc., of property submitted
to MLS shall be of the subject property only, and shall not
include any form of company emblem, logo, or company / agent /
seller self-promotion (which includes “For Sale / Lease / etc.”
or Company / Agent / Seller signage), or any digitally enhanced
verbiage or alterations, which includes modified renderings of
an existing structure. MLS staff shall have the right to
digitally enhance or remove any image to make it compliant to
these guidelines. (Images from the Auditors are not
allowed due to their digital branding.)
- 14.4 A primary photo or
sketch for each property entered into MLS is required and
provided by the Participant entering the listing. (All
listings regardless of status - even "Sold Before Sent,"
Cancelled, Withdrawn or Expired listings need a primary exterior
photo.

- 14.6 The Participant is
responsible for taking and either submitting to MLS or uploading
a primary image on to the MLS computer within 5 business days of
the listing entry date.
- 14.10 Copyright: ...
Images submitted to MLS that are not owned by the MLS
Participant or its licensees, where the express written consent
for their use has not been acquired, are considered in violation
of the MLS rules and copyright law. Such images shall be
immediately removed by the MLS and the listing broker shall be
subject to a fine for each listing in violation. If necessary,
upon further review by the MLS leadership, other punitive
actions may be issued for such violations.
- 16.4 Retention of Listings in
MLS: For listings that are Active, Pending or Withdrawn, the
listing data, primary images and multiple images shall remain in
the MLS database until changed to an inactive status. For
listings that are Leased, Expired or Cancelled, the listing data
shall remain in the MLS database indefinitely; the primary
images shall remain indefinitely; the multiple images shall be
purged after one (1) year. For listings that are Sold / Closed,
the listing data shall remain in the MLS database indefinitely;
the primary images shall remain indefinitely; the multiple
images shall be purged after five (5) years.

Update on LEASE/RENT, please remember:
A property (Single Family, Condo, Farm or Apartment) can be entered as "Lease/Rent" only & also as "Residential" For Sale!
"Lease/Rent" listings are optional entry in CincyMLS, however, all of the same MLS "Rules & Regulations" apply when a listing is entered.
This includes paper work & photos. Only an "Exclusive Right to Lease" shall be accepted for New Lease/Rent Listings.
Compensation can be entered either as a Dollar Amount $ or Percentage %.
If you enter a % for compensation, you must use the Agent Only Remarks to describe upon what the % is based.
New! The final "Leased" status has been enhanced for all listings! Active > Pending > Leased
For Lease/Rent Listings: "Leased" status now requires "Leasing Date" "Leasing Price" "Leasing Office" and "Leasing Agent."
For all other "For Sale" listings: "Leased" status now requires "Leasing Date" "Leasing Price" "Leasing Office" "Leasing Agent." "Leasing Financing Terms" will default to "N/A."
Remember that for all pre-existing "Leased" status listings, these new fields will be "blank" and only listings changed to "Leased" from this point forward will show this data and will be searchable.
Scenarios and Resolutions: Listings Both "For Sale" and also "Lease/Rent":
If the property is "Leased" under Lase/Rent Property Type: the "For Sale" listing must be changed to "Cancelled" (or "Expired") - unless it is still available "For Sale."
If the property is "Sold": the "Lease/Rent" listing must be changed to "cancelled" (or "Expired").
Listings Only "For Sale":
If the property is "Sold" on a lease purchase/land contract, the listing must be changed to "Sold" status.
If the property is "Leased" with option to purchase, the listing should be changed to the "Leased" status.
If the option to purchase is executed, you can contact CincyMLS staff to change the status from "Leased" to "Sold."
If the property is simply leased/rented, change the listing to "Leased" status.
Optionally, you can "Cancel" the "For Sale" listing and enter a "Lease/Rent" listing as "Leased Before Sent."
Listings Only "For Lease/Rent":
If the property is leased/rented, change the listing to "Pending" and then to "Leased" status.

Beginning Tuesday morning, March
13, 2012, all listings will display a new Days on the
Market calculation labeled, "DOM/CDOM."
Click here for a visual representation.
You will continue to see the DOM calculation (from list date to
the listings inactive date). You will also see the new CDOM
calculation: a) within a "1-30 day" period between listings, a
new listing will continue the DOM count from the previous
listing under CDOM; and b) for any new listing entered 31 days or
more past the prior listing, the CDOM will start at 1 day.
Hint! Always look for the most recent listing,
no matter what status, to see the correct CDOM "sequence."
Lease/Rent listings shall calculate their own DOM/CDOM. These
listings will NOT be included in the CDOM calculations for
Residential or Multi-Family property types.
CDOM will only appear: a)
on the history display and report; b)
on the listing detail display; c)
on the One Line and Hotsheet Grid displays; d) on the CMA
report; and e)
on the View/Revise Listings Page (One Line ICON display).
CDOM will not initially appear on the various print reports. CDOM
will not initially appear on the One Line, With Pictures and Without
Pictures displays. DOM/CDOM will not appear on any public viewable
pages including IDX, e-mailed listings or listing detail links.

New Field: AVAILABLE
FINANCING
"Available Financing"
is now available for Residential, Multi Family, Land and Commercial
listings. This new field will be required for all listings where
"Special Financing = Yes." (listings where "Special Financing
= No" will not require this new field)
The choices for "Available Financing"
are: Assumable, Owner, Land Contract, Exchange, Lease Option,
Lease Purchase and Other. All new listings and all
listings revised where "Special Financing = Yes"
will require that at least one choice to be selected to "Submit" the
listing. (you can select multiple choices)
For all on-market listings
(Active, Pending, Withdrawn) where "Special Financing" = "Yes," please update your
listings ASAP by selecting at least one choice for "Available
Financing."

Effective September 1, 2011,
for all Fannie Mae and Freddie Mac property, and
effective January 1,
2012, for all FHA property, any appraisal
completed by an appraiser MUST follow the Uniform Appraisal Dataset
(UAD) format and all the required UAD forms MUST be filled out
completely and accurately for the appraisal to be accepted.
Why
is this important to you? The appraiser will
be required to collect information on any improvements made to the
subject property and the completion date of each. They will be
required to provide adequate explanations in the addendum of the
reporting form regarding methodology, anomalies, property
deficiencies and other conditions that may have an impact upon the
value of a property and its marketability. Without this information,
there MAY be delays in processing the appraisal or discrepancies in
the valuation.
What
can you do to help? The OCAP (Ohio Coalition
of Appraisal Professionals) is asking the assistance of all real
estate professionals in the collection of information required of
the appraisers to complete the appraisal timely and completely. Your
assistance will help to avoid any appraisal delays or possible
property value discrepancies.

Beginning
Monday, June 20, 2011, Rapattoni will begin the process of purging /
deleting the following items from the MLS system:
1) Multiple Photos Only - (the primary photo will remain) -
on listings that have been under the "Expired, Cancelled or
Leased" status for one (1) year or more;
2) Multiple Photos Only - (the primary photo will remain) -
on listings that have been under the "Sold" status for five (5)
years or more; and
3) Attached Documents - on listings that have been under the
"Expired, Cancelled, Leased or Sold" status for one (1) year or
more. NOTE:
Removal of the multiple photos and attached documents will NOT
impact current active listings, pending listings or withdrawn
listings. Following
the guidance of MLS attorney, the Leadership approved this action to
reduce broker and agent liability for maintaining old photos or
documentation on individual listings. If you need to save a copy of
the photos or documentation on your older listings, please take the
time to print or save those records prior to June 20. Once the
photos and documentation have been deleted, the information cannot

The Cincinnati MLS has been made aware
of situations where the MLS rules regarding the sharing of login IDs
and passwords have been in violated. Some examples of password
sharing violations include appraisers sharing their access with
other non-MLS registered appraisers; brokers, agents, assistants and
admins who share their logins and passwords with investors and other
consumers, even those in foreign countries; and brokers, agents and
appraisers who share their passwords with vendors.
Rapattoni has provided the MLS with software able to monitor
accesses and to assist the MLS in finding those who are violating
the rules. Punitive action could include fines and could
result in the suspension or expulsion of the agent,
appraiser, broker or company. Remember: The broker /
appraiser Participant is ultimately responsible for the actions of
their agents, appraisers, assistants, administrators and those
non-employees affiliated with their company. Sharing of login ID's
and passwords is a serious matter and will be dealt with in the
appropriate manner.
If anyone other than you knows your login ID and password, then you
are in violation of the MLS rules. To correct this, please change
your password immediately.

such practice and change your password immediately. MLS will
investigate all reported cases and anyone found in violation will be
brought before the MLS Committee and Directors.

Client Portal is an interactive view of listings in a
personalized webpage you can provide to your Client as an
alternative to the traditional prospect e-mails. Your contact
info, photo &
Office Banner are featured at the top. When you
provide your prospect with a Client Portal, they can view
the listings in their Newly Matched, Saved, Recommended & Rejected
tabs, post comments about listings (blog), & even manage

MLS Board of Directors recently approved the ability of a Broker
Participant to apply for and acquire 2 or more IDX data feeds.
A Broker can only use these additional data feeds for the purpose of
adding a consumer listing search to secondary, locally-branded,
company websites owned and operated by that Broker. With this new
ability, agents can acquire an IDX data feed, with the written
permission of their broker! This data feed may only be used for the
creation of an IDX consumer search on an agent’s personal website.

School District Search is now
available on the SEARCHES menu. (formerly known as Quick
Search) Use this search when the primary criteria of your
search is the School District(s). The school district names have
been changed so that your search will result in all possible
matches. As an example, Princeton City SD is in Hamilton, Butler &
Warren counties. Previously each district's name ended in -Hamilton
or -Butler or -Warren. It was necessary to pick all 3 for all
results. Now the name is simply "Princeton City SD." It is no longer
necessary to pick all 3, picking "Princeton City SD" from any
county, will automatically result in all listings regardless of
county. (picking 1, picks all 3 - unless additional geographic
criteria is used) The School District search offers the
Map/Radius & County search criteria options if you want to hone in
on a more specific location. The school district criteria is still
available on the other Rapattoni searches.
Note! If you have a Saved Search or Saved Prospect Search
where the criteria includes school district(s), it is
recommended you revise the search criteria to re-select the
district(s) to make sure your searches continue to run successfully.
With this new information, you may wish to delete & recreate the
search(s) entirely. All listings have been updated. All IDX (BR)
vendors have been notified of the district name changes. Vendors who
use a pick/select lists may have to refresh the list to match the
new district names. |

Open Houses information is now available to the public on
Realtor.com. (In addition to
CincyMLS.com
and on any
Broker's website that provides an MLS open house search.)
1) To search for Open Houses on Realtor.com go to
www.realtor.com
2) Enter your geographic location (city/municipality or zip code)
3) Enter any other criteria on that page (Price Range, Beds,
Baths)
4) Click "Advanced Search"
5) On the left hand side click "Display Options"
6) Check-off "Open houses"
7) Click "Search"
Note! If you have a Realtor.com account/enhanced services,
you will have to logon to your account and authorize the use and
display of the Open House information. If you do not have a
Realtor.com account/enhanced services, the
Open House information will automatically be displayed.
Hint! Basic Open House information will be displayed
on all search results - not just the "Open House" search results, as
long as it has been entered into CincyMLS.

Reminder: Cincinnati MLS uses the CAGIS
system (http://cagis.hamilton-co.org)
as the property location source for the neighborhoods of the City of
Cincinnati. MLS reviews all new listings and verifies that the
property is placed in its physical location per CAGIS.
Properties impacted the most by this verification are those close to
the border of two or more adjoining neighborhoods. Prior to CAGIS,
there was no source to verify the properties neighborhood location.
This service makes verification easier and more accurate per census
tract data, community councils and city planning.
If MLS verifies that the suburb code (SIC) entered for a Cincinnati
neighborhood is not correct per CAGIS, MLS will make the change and
notify the listing agent, by e-mail, of that change. If the listing
location is changed by the agent or office, such a change is a
violation of the MLS rules and is subject to punitive action for
each time the listing is changed. |

Cincinnati MLS and
Point2 Agent have begun syndicating your MLS listings as of today.
Your listings will be syndicated to and appearing on all the
partners' sites that your broker and you have selected in your
Syndication Dashboard within the next 24-72 hours. Then, all
statistics and prospect data (leads) will be provided back to you
within your Syndication Dashboard. If you have not activated your
Syndication Dashboard, you will want to get one set up right away.
Please check your e-mail for your dashboard activation notice
(Brokers sent on 1-6-10) (agents sent on 1-12-10). Please follow the
instructions on that e-mail to activate your free
dashboard.

"Cumulative" and
"Snapshot" Market Conditions Reports:
There are now two
versions of the
Market Conditions Summary Report. The original report is now
labeled "Cumulative," because it calculates the total number
of comparable active listings based on the number of listings that
were on the market for all or part of the specified time
period. The new "Snapshot" version of the Market
Conditions Report bases the total number of comparable active
listings on the number of listings that were on the market on
the end date of the specified time period.

Auto-Prospecting E-mail Options More Flexible:
Previously, you had to have Auto-Prospect e-mails sent to yourself
in order to have Auto-Prospect e-mails sent to your prospect. This

You can now search remarks with more flexibility. Use the radio buttons between the fields to specify how the criteria should apply. You can choose to search only one of the remarks fields, or enter criteria in both fields and select the "Or" radio button to find listings that match the criteria you have entered in either of the remarks fields (recommended), or enter criteria in both fields and select the "And" radio button to specify that the word or phrase must be found in both remarks fields. Revised FHA Condominium Policy Implementation:
If you state anywhere on an on-market Condominium listing in MLS that the condo is "FHA approved" or "has FHA approved financing," it is HIGHLY
recommended that those remarks be removed if those condos were
FHA-approved PRIOR to Oct. 1, 2008 (approx. one year ago)
FHA policies have recently changed:
1) As of Oct. 1, 2009, all lender "spot approvals" are terminated.
2) Effective Nov. 2, 2009, all condos with "permanent" FHA approval status granted PRIOR to Oct. 1, 2008 will be rescinded. This means that these condo complexes MUST be re-approved by FHA.
3) Mortgagee Letter 2009-19 describes the new approval process for Condo Projects, allowing lenders to determine project eligibility, review project documentation, and certify to compliance of Section 203(b) of the National Housing Act and 24 CFR 203 of HUD rules. This new approval process will be effective for all case numbers assigned on or after Nov. 2, 2009.

55+ Community is a new choice under the "Miscellaneous features" for Residential property. This language is the appropriate, confirmed language under the fair housing laws.
PLEASE NOTE: According to HOME (Housing Opportunities Made Equal), by saying a housing development is a 55+ community, it means that at least 80% of the occupied units have someone 55 years or older, and therefore the community has a legal exemption and can deny families with children. This is a VERY important qualifier. |

When searching by school district,
(e.g. Talawanda School District in Butler County), it is highly
recommended that you DO NOT enter Area codes and SICs (e.g. W15
(Hamilton City) or W17 (Hanover Twp) to find property matches.
New developments near and within the corporate line of a city in one
area (W15) MAY be within the school district of the Township (W17).
MLS rules, 9.2 and 15.2.c., which have existed for years, requires a
listing to be entered into its correct, physical location.
You may be missing listings that meet your buyer’s criteria by
searching one (1) area code or SIC and a school district.
This is especially true for properties that reside in a city limits
that are just outside a township (e.g., Hamilton City (W15) and
Hanover Twp. (W17). Some new property located in the City of
Hamilton in W15 is in the Talawanda School District.
Remember: If you search by school district, remove the area and sic
codes before searching. |

Limited Service Listing (Y/N) is a new, required data field in MLS
In Oct 2006, the State of Ohio enacted a law regarding mandatory, real estate Minimum Service guidelines. Click here for the guidelines & here for the required form.
To disclose those listings where the listing broker provides limited services, a new field is now available in MLS called, "Limited Service Listing (Y/N)." Per Ohio law, if a seller has waived any required services of the listing broker, the broker must disclose to coop brokers that a waiver exists & must provide instructions to the coop broker on what interaction with the seller is permitted. This can be accomplished by providing instructions in the "Agent Remarks."

Examples of Possible
Scenarios where Limited Service = Yes:
1) When representing a Builder
2) When a consumer wants to handle all showings and/or negotiations
3) HUD listings
4) REO listings

This new field will be available on Monday, March 31, as an optional
entry for the next week. During this time it is highly recommended
that you look into this law, what is required of you, & that your
current active, pending & withdrawn listings are changed to reflect
the proper response of Limited Service Listing = Yes or No.
On Monday, April
7, the field will become a required field of entry. This means that
any new listing or revised listing will require an entry (Y/N) from
this time forward. "Limited Service" will print on the Full
Agent Detail Report. |

EnteringThe amount you enter into the
compensation fields is UNCONDITIONAL and the listing broker is
liable to pay the difference. The Sub-coop and Buy-coop field
entries take priority over any remarks.
You are only permitted to enter a single amount with either a $ or %
sign in the Sub-coop or Buy-coop fields. Ranges are NOT permitted
(e.g. X-X%).
You may add clarification in the agent remarks that allow equal or
greater compensation earnings.
Always enter a $ or % sign. These are important so the coop broker
knows if the compensation is a $ amount or %.
At NO time can both fields have a "0" entry. One may have "0”, but
NOT both. Listings with "0" in both may be removed from MLS.
If compensating ONLY buyer agents; enter an amount greater than "0"
in the buy-coop field; "0" in sub-coop.
Examples of what is NOT to appear in the compensation fields: "*",
min, flat, max, x%-x%, x%/x, call, etc. These and other entries are
prohibited per the MLS rules.

C01-BT (Batavia Twp.), C01-AM (Amelia), C01-BA (Batavia), etc.) to

the MLS Committee and Directors, such as, but not limited to
suspension of services, up to a $1,000 fine and even possible
expulsion from the MLS.
